TERMS OF SERVICE

SECTION 1: OVERVIEW
This website is operated by CybernatiX LLC, doing business as Posthuman Lab (“Posthuman Lab,” “we,” “us,” “our”). By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced here.

These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that allows us to sell products and services to you.

SECTION 2: ELIGIBILITY AND AGE REQUIREMENTS
By using the Service, you represent that you are at least the age of majority in your state/province of residence, or you have obtained valid consent from a parent or legal guardian.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including copyright laws).

SECTION 3: CHANGES TO THESE TERMS
We may update these Terms from time to time by posting an updated version on this page. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.

SECTION 4: GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any lawful reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.

SECTION 5: ACCURACY OF INFORMATION
We do not guarantee that information on this site is accurate, complete, or current. The material is provided for general information and may be updated without notice.

SECTION 6: PRODUCTS, AVAILABILITY, AND PRICING
All product descriptions, images, and pricing are subject to change at any time without notice. We reserve the right to modify or discontinue any product at any time.

We make reasonable efforts to display product colors and images accurately, but we cannot guarantee that your device’s display will be accurate.

SECTION 7: ORDERS, BILLING, AND ACCOUNT INFORMATION
We reserve the right to refuse or cancel any order. We may limit or cancel quantities purchased per person, per household, or per order.

You agree to provide current, complete, and accurate purchase and account information, and to promptly update your information so we can complete transactions and contact you as needed.

SECTION 8: PAYMENTS AND THIRD-PARTY PAYMENT PROVIDERS
Payments may be processed through third-party providers (for example, Shopify Payments, Shop Pay, or buy-now-pay-later providers). Your use of those services may be subject to the provider’s separate terms and policies. We are not responsible for third-party payment provider outages, errors, or decisions.

SECTION 9: SHIPPING, DELIVERY, TAXES, AND DUTIES
Our shipping terms are governed by our Shipping Policy (available on our site). In the event of any conflict between these Terms and the Shipping Policy, the Shipping Policy will control for shipping-related topics.

Key points currently include:

1. Complimentary Worldwide Shipping. For remote regions, shipping rates will be applied at checkout. 

2. Estimated delivery times are estimates only and are not guaranteed. Processing typically requires 1–2 business days before dispatch.

3. Customs and duties: Orders under $300 have taxes included; orders over $300 may require the customer to pay local import duties and taxes directly to the courier. 

Risk of loss passes to you upon delivery to the carrier to the extent permitted by law. If you believe your parcel is lost or significantly delayed, contact us and we will assist with carrier investigations and any shipping insurance process that applies.

SECTION 10: RETURNS, EXCHANGES, AND REFUNDS
Returns and exchanges are governed by our Refund Policy (available on our site). In the event of any conflict between these Terms and the Refund Policy, the Refund Policy will control for return-related topics.

Key points currently include:

1. 14-day returns and 14-day exchanges for eligible items, counted from delivery date. 

2. Purchases made between November 23 and December 31 may be eligible until January 30. 

3. Some items are not returnable or exchangeable, including custom measurement 3D-printed items and certain hygiene-restricted items (e.g., earrings, nose and lip cuffs).

4. Items from the “exclusive deals” section may be excluded from returns. 

5. Refund timing depends on inspection and payment processor timelines. Original duties/taxes paid may be non-refundable and return shipments may require duties to be prepaid to clear customs. 

SECTION 11: ORDER CHANGES AND CANCELLATIONS

1. Order changes (address, size, or color): Requests must be made as soon as possible. Once an order enters fulfillment or production, changes may not be possible.

2. Cancellation for change-of-mind (standard items): You may request cancellation within 24 hours of placing the order, provided the order has not entered fulfillment.

3. On-demand 3D printed items: Cancellation is only available within 24 hours after order placement. After the 24-hour window, orders cannot be cancelled because production begins immediately. 

4. Pre-orders: You may request cancellation within 10 days after placing a pre-order. After that window, cancellation may not be available once production begins. 

All cancellation approvals are at our discretion to the extent permitted by law and may be subject to non-refundable processing fees if already incurred.

SECTION 12: ENGRAVING, GIFT WRAPPING, AND GIFT MESSAGES
Where offered at checkout, gift wrapping, gift notes, and engraving are provided.

Engraved orders may require additional processing time prior to dispatch, and delivery estimates may be extended accordingly. 

SECTION 13: INTELLECTUAL PROPERTY
All content on this site, including trademarks, logos, product names, text, graphics, and images, is owned by or licensed to Posthuman Lab and is protected by applicable intellectual property laws. You may not use our content without our prior written permission.

SECTION 14: USER COMMENTS AND SUBMISSIONS
If you submit ideas, suggestions, or other materials, you agree we may use them without restriction and without compensation, unless prohibited by law.

You agree not to submit unlawful, abusive, defamatory, obscene, or infringing content, or content containing malware or malicious code.

SECTION 15: THIRD-PARTY LINKS AND TOOLS
We may provide access to third-party tools or links. We do not control third-party services and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

SECTION 16: PRIVACY
Your submission of personal information through the store is governed by our Privacy Policy (available on our site). If you do not currently have a published Privacy Policy, you should publish one before treating US traffic as “in compliance.”

SECTION 17: DISCLAIMERS
The Service and all products are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, except where such disclaimers are prohibited.

Some jurisdictions do not allow limitations on implied warranties, so some of the above may not apply to you.

SECTION 18: LIMITATION OF LIABILITY
To the fullest extent permitted by law, Posthuman Lab will not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits or lost data, arising from your use of the Service or products.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the maximum extent permitted by law.

SECTION 19: INDEMNIFICATION
You agree to indemnify and hold harmless Posthuman Lab and its affiliates, officers, directors, agents, contractors, and employees from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party rights.

SECTION 20: TERMINATION
These Terms are effective unless and until terminated by either you or us. We may terminate or suspend access to the Service if we believe you have violated these Terms.

Obligations and liabilities incurred prior to termination survive termination.

SECTION 21: GOVERNING LAW AND VENUE
These Terms and any disputes arising out of or related to the Service will be governed by the laws of the State of Delaware, USA, without regard to conflict of law rules.

You agree that any legal action will be brought in the state or federal courts located in Delaware, unless mandatory consumer protection laws in your jurisdiction require otherwise.

SECTION 22: SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions will remain in full force and effect.

SECTION 23: ENTIRE AGREEMENT
These Terms, together with policies referenced herein (including the Shipping Policy and Refund Policy), constitute the entire agreement between you and us regarding your use of the Service, superseding prior agreements and communications.
